TERMS OF SERVICE

1. Scope

These Terms of Service ("Terms") govern the use of the website www.quantitrading.com (the "Site") and all services offered by Quanti Trading SAS ("Quanti Trading", "we", "us"), including but not limited to: subscription-based access to monthly or yearly portfolios compositions, video tutorials, live coaching sessions, private community access, email reports, and educational materials (collectively, the "Services").

By accessing the Site or subscribing to any Service, you ("the User", "you") acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the Site or subscribe to any Service.

2. Nature of the Services - Critical Disclaimer

Quanti Trading is a publisher of financial education and information content. We are NOT a registered investment adviser, broker-dealer, or financial institution in any jurisdiction outside France.

Our Services consist of publishing the composition of a model portfolio on a regular, pre-announced schedule, along with educational content. This information is provided on a general, impersonal basis and is NOT tailored to any individual's financial situation, objectives, or risk tolerance.

Nothing in our Services constitutes a personal recommendation to buy, sell, or hold any security. Any decision to invest is made solely by you, at your own risk, through your own broker account, over which we have no access or control.

Past performance, including backtest results, is not indicative of future results. Investing involves risk of loss, including the possible loss of all capital invested.

Before making any investment decision, consult a licensed financial adviser, tax professional, and legal counsel qualified in your jurisdiction.

3. Eligibility

The Services are available to individuals who are at least 18 years old and legally capable of entering into binding agreements. By subscribing or buying, you represent and warrant that you meet these requirements and that all information you provide is accurate and truthful.

You acknowledge that it is your sole responsibility to verify whether accessing and using our Services complies with the laws and regulations of your country or state of residence, particularly with regard to securities regulations.

4. Offers and Pricing

The Services and their prices are described on the Site at the time of your order. Prices are displayed in euros or dollars USD, inclusive of all taxes (TTC), unless otherwise indicated. Quanti Trading reserves the right to modify its offers and prices at any time, without affecting orders already confirmed.

Certain offers may include installment payment options (e.g., 4 monthly installments). In such cases, automatic monthly charges will be applied to the payment method provided at the time of the order. All installments become due from the moment access to the Service content is granted.

5. Payment

Payments are processed securely through Stripe (https://stripe.com) and/or PayPal (https://paypal.com). All payment information is encrypted and transmitted directly to these payment processors. Quanti Trading does not store your full payment card details.

In the event of a failed payment, up to three additional attempts will be made automatically. If the payment remains unresolved, access to the Services will be suspended. However, the full amount of the subscription remains due. Persistent non-payment may result in legal proceedings and/or permanent ban from the Services.

6. Right of Withdrawal

In accordance with Article L221-28, 13 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a physical medium, where performance has begun with the consumer's express prior agreement and acknowledgment that they thereby waive their right of withdrawal.

By subscribing or buying to our Services and accessing the digital content, you expressly agree to the immediate execution of the contract and acknowledge that you waive your right of withdrawal from the moment access to the content is granted.

This provision applies exclusively to digital content. For Services not yet accessed, consumers residing in the EU may exercise their right of withdrawal within 14 days of purchase by contacting us at contact@quantitrading.com, provided no digital content has been accessed.

7. Cancellation and Refund

Subscriptions are for the duration selected at the time of purchase (e.g., 1 year, 3 years). They are not subject to early termination by the User, except as provided by applicable mandatory consumer protection law.

Refund requests based on investment performance are not accepted. Quanti Trading provides educational content, not investment results. You acknowledge and accept this distinction.

Notwithstanding the foregoing, Quanti Trading may, at its sole discretion, grant a partial or full refund on a case-by-case basis for exceptional circumstances.

8. User Obligations

You agree to: (a) use the Services in compliance with applicable law and these Terms; (b) provide truthful and accurate information; (c) keep your login credentials confidential and not share them with third parties; (d) not reproduce, distribute, resell, or share any content from the Services without prior written consent from Quanti Trading; (e) not make defamatory, abusive, or misleading statements about Quanti Trading on any platform.

Violation of these obligations may result in immediate termination of access without refund and, where applicable, legal action.

9. Intellectual Property

All content provided through the Services (text, videos, images, software, data, methodologies, portfolios compositions) is the exclusive intellectual property of Quanti Trading and is protected by French and international intellectual property law (notably Articles L.111-1 and following of the French Intellectual Property Code).

Your subscription grants you a personal, non-exclusive, non-transferable, revocable right to access and use the content for your own private, non-commercial purposes only. Any reproduction, distribution, public communication, or commercial use without prior written consent constitutes infringement.

10. Limitation of Liability

Quanti Trading's obligation is one of means, not results. We do not guarantee any particular investment outcome.

To the maximum extent permitted by applicable law, Quanti Trading shall not be liable for: (a) any investment losses incurred by the User; (b) any direct or indirect damages arising from the use of the Services or reliance on their content; (c) any technical malfunction, interruption, or unavailability of the platform; (d) any actions taken by the User based on the published content.

In any event, Quanti Trading's total aggregate liability shall not exceed the total amount paid by the User for the current subscription period or paiement.

11. Force Majeure

Quanti Trading shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, strikes, power outages, internet disruptions, cyberattacks, pandemics, or government actions, as defined under Article 1218 of the French Civil Code.

12. Governing Law and Dispute Resolution

These Terms are governed by French law.

In the event of a dispute, the parties shall first attempt to resolve the matter amicably. In accordance with Articles L.611-1 and R.612-1 of the French Consumer Code, you may also refer the matter to a consumer mediator.

If no amicable resolution is reached, the dispute shall be submitted to the competent courts under the rules of French law, subject to mandatory consumer protection provisions granting jurisdiction to the courts of the consumer's place of residence.

13. Modifications

Quanti Trading reserves the right to modify these Terms at any time. The updated version will be published on the Site with a revised "Last updated" date. Continued use of the Services after modification constitutes acceptance of the new Terms. For material changes, we will notify you by email at least 30 days in advance.
